Requests for internal review

Overview

It is possible for environmental non-governmental organisations (NGOs) that meet certain criteria and for the members of public subject to certain conditions to request the European Commission to undertake an internal review of administrative acts adopted by the Commission if it is considered to contravene EU environmental legislation. Such a request must be submitted within 8 weeks after the administrative act has been adopted or published in the Official Journal.

How to submit a request for internal review?

Requests for internal review should be submitted to the European Commission by ENV-INTERNAL-REVIEWatec [dot] europa [dot] eu (e-mail) until 28 April 2023.

Pursuant to Article 11a paragraph (2) of Regulation (EC) No 1367/2006, for the sake of transparency and effective case handling, the Commission has established an online system with the objective that all requests addressed to the Commission are submitted through this system as of 29 April 2023.

To whom should the request itself be addressed?

The formal request for internal review of an administrative act or relating to an administrative omission should be addressed to the relevant department (Directorate-General) responsible for the application of the provision on the basis of which the administrative act was adopted, or in respect of which the administrative omission is alleged.

What are the detailed rules for submitting a request?

The Commission has adopted two decisions to implement further the Regulation:

  • Commission Decision (EU) 2023/748 of 11 April 2023 laying down detailed rules for the application of Regulation (EC) No 1367/2006 of the European Parliament and of the Council as regards requests for the internal review of administrative acts or omissions.

    This Commission Decision repeals Decision 2008/50/EC. Based on the new articles of the amended Aarhus Regulation not only NGOs, but also other members of the public are able to submit internal review requests. The start of application of the provisions on the new categories of members of the public is 29 April 2023. In accordance with Article 11 (1a) of Regulation (EC) No 1367/2006 in the cases of requests submitted by other members of the public they shall be represented by an environmental non-governmental organisation or by a lawyer authorised to practise before a court of a Member State. Article 7 paragraph (1) of the Commission Decision (EU) 2023/748 establishes that all requests for internal review in accordance with Article 10 of Regulation (EC) No 1367/2006 addressed to the Commission shall be submitted only via the online system for receipt of requests for internal review and specifies what documents are necessary to be submitted for each category of applicant.

  • Commission Decision 2008/401/EC, Euratom of 30 April 2008 amending its Rules of Procedure as regards detailed rules for the application of Regulation (EC) No 1367/2006 of the European Parliament and of the Council on the application of the provisions of the Aarhus Convention on Access to Information, Public Participation in Decision-making and Access to Justice in Environmental Matters to Community institution and bodies.

    This Decision ensures that the General principles and minimum standards for consultation of interested parties by the Commission [COM(2002) 704] apply to public participation concerning plans and programmes relating to the environment. It also assigns clear responsibilities and decision-making powers to the appropriate bodies or persons within the Commission with respect to the provisions of the Regulation concerning requests for internal review.

Potential applicants are further informed that, in cases involving identical claims from several applicants, a single request co-signed by all applicants and with one NGO as the designated contact point to which the Commission’s reply can be sent, is preferred to individual requests.

Where the Commission cannot respond to an internal review request in the language of the request within the (extended) deadline, it will aim at providing an English version of its response by that date and follow up with a translation in the language of the request as soon as possible afterwards.
